Product Giveaway

1. Scope

1.1 The following general terms of participation (hereinafter: Terms of Participation) apply to all giveaways conducted by Preisvergleich Europe GmbH, Hammerbrookstr. 93, 20097 Hamburg, Germany (hereinafter: Organiser). By participating in the giveaway, participants expressly accept these Terms of Participation.

1.2 Our giveaways are in no way connected to YouTube and are not sponsored, endorsed or organised by YouTube. All information provided in connection with these giveaways is provided exclusively by the Organiser.

2. Eligibility

2.1 All natural persons who have reached the age of 18 and whose place of residence is in Germany are eligible to participate. Shipping to addresses outside of Germany is not possible.

2.2 Participation is only possible within the respective giveaway period. Employees of the Organiser and their immediate family members are excluded from participation.

2.3 The Organiser reserves the right to exclude persons from participation who violate these Terms of Participation or who gain or attempt to gain an unfair advantage through illegitimate manipulation of the giveaway (e.g. multiple entries in a single giveaway). In such cases, the Organiser may also retroactively exclude participants from the giveaway, revoke prizes and reclaim them, and exclude participants from future giveaways.

3. Giveaway Period

3.1 Each giveaway begins at the time of publication of the corresponding video on YouTube in which the giveaway is announced. Each giveaway ends at the time stated in the respective video description.

4. Participation and Conduct of the Giveaway

4.1 Participation is effected by commenting on the video in which the giveaway is announced, using the YouTube comment function of the respective video. Should additional requirements for participation in the giveaway apply, these will be communicated in connection with the publication of the respective giveaway.

4.2 The giveaway is only conducted within the respective giveaway period. All participants who are eligible and who fulfil the stated participation requirements by the time of the draw will be considered. Immediately after the participation deadline expires, the winner will be drawn at random from among the participants.

5. Prizes

5.1 The products to be won in each giveaway are the test devices presented in the corresponding video. Any deviations from this will be specified in the giveaway description.

5.2 The products given away are predominantly test devices that may show signs of use. There is no entitlement to new goods. The Organiser is not liable for goods damaged during shipping or non-functional upon receipt. There is no entitlement to a replacement.

5.3 Modification, exchange or cash payment of the prize is excluded. The prize is non-transferable.

6. Winner Notification and Prize Fulfilment

6.1 After the end of the giveaway period, the winners are determined at random and announced in the comments of the respective video published on YouTube.

6.2 The winner must confirm their prize within 7 days of notification by contacting the Organiser by email at verlosung@pveu.com and declaring acceptance of the prize. Otherwise, the Organiser reserves the right to draw a new winner.

6.3 To verify identity, the Organiser will send the winner a 2-FA code in reply. The winner must edit their original comment within 7 days and insert the code. This is the only way the Organiser can ensure that the person is indeed the one who posted the winning comment.

6.4 After successful verification, the Organiser will request by email the address to which the prize should be shipped. If the winner does not provide a shipping address within 7 days, the Organiser reserves the right to draw a new winner.

6.5 If the contact details provided by the participant (e.g. address) are incorrect, the Organiser is not obliged to determine the correct details. Any disadvantages arising from the provision of incorrect contact details are borne by the participant. Likewise, the participant is responsible for ensuring that delivery can be made in the event of a win. If delivery of the prize is not possible, there is no entitlement to a further delivery attempt.

7. Data Protection

7.1 The Organiser collects and processes personal data of participants exclusively for the purpose of conducting the giveaway and fulfilling the prize. Data will not be shared with third parties unless this is necessary for the fulfilment of the giveaway. The Organiser is responsible for data processing in connection with the giveaway.

7.2 For the purpose of conducting the giveaway, the profile name of all participants is collected and used for the draw. For the fulfilment and dispatch of the prize, the winners' email address, first name, surname and postal address are additionally collected. Name and address are shared with a shipping company commissioned with the dispatch of the prize. The legal basis for this processing of your personal data is Art. 6(1)(b) GDPR.

7.3 Personal data processed in connection with the giveaway will be deleted no later than three months after the end of the giveaway, provided there is no legitimate interest in the further storage of such data.

7.4 The giveaway is further subject to our privacy policy, which is available at https://www.pveu.com/datenschutz. Please note in particular the data subject rights and the right of objection set out therein.

8. Liability

8.1 The Organiser is not liable for damages arising from participation in the giveaway, regardless of the legal basis, unless such damages are attributable to gross negligence or wilful misconduct on the part of the Organiser.

9. Final Provisions

9.1 Legal recourse is excluded. The law of the Federal Republic of Germany shall apply.

9.2 The Organiser is entitled to end, modify or amend the giveaway at any time without prior notice and without giving reasons, in particular if the proper conduct of the giveaway cannot be guaranteed without such measures for technical or legal reasons.

9.3 The invalidity of individual provisions of these Terms of Participation shall not affect the validity of the remaining provisions. In the event that a provision is invalid, it shall automatically be replaced by a valid provision that comes as close as possible to the purpose of the invalid provision.

9.4 By participating in the giveaway, participants accept these Terms of Participation as binding.
